Terms of service
Effective 4 May 2026. Governs all orders, subscriptions, and event reservations placed through this site.
1. Trader identity
These terms apply to agreements between you (the "customer") and Flamenco, an artisan Spanish food business based in Amsterdam, the Netherlands. They cover sales to consumers through this site; sales to business customers (B2B) are governed by separate written agreement.
- Trade name: Flamenco
- Owner: Alejandro Torres Gayan (eenmanszaak)
- Registered address: Admiralengracht 158-3, 1057 GH Amsterdam, the Netherlands
- Chamber of Commerce (KvK): 88546349
- VAT (BTW): NL004620704B62
- Email: flamenco.import@gmail.com
2. Acceptance and changes
Placing an order, signing up for a subscription, or reserving a seat at an event means you accept these terms as they stood on the date of the transaction. We may update them; changes apply only to orders placed after the new effective date. Material changes affecting active subscribers will be notified by email at least fourteen days before they take effect.
3. Products and descriptions
We import small-production Spanish food and drink — oils, vinegars, cured meats, cheese, and related pantry goods — sold individually through the catalog and as a curated monthly box through the subscription. Producer names, regions, and origin statements reflect what each producer has told us; we do not independently certify organic, DOP, or similar claims unless explicitly stated.
Product photography is representative. Vintage, harvest, and batch may vary between deliveries within the limits of the same producer and product line.
4. Prices, currency, and VAT
All prices are in euro (EUR) and include Dutch VAT at the applicable rate. Subscription pricing displays a per-month rate for comparison; the actual amount debited each cycle is the cycle total stated at signup. Delivery costs, where applicable, are shown before checkout. Mollie receipts itemize the VAT line.
5. Orders and payment
Payment is processed by Mollie B.V. (a licensed Dutch payment institution). Catalog enquiries and event reservations are paid by iDEAL. Subscription billing is taken by SEPA Direct Debit under a mandate captured at signup via an iDEAL first-payment confirmation. We do not see, store, or process card or bank account numbers; Mollie holds the full PCI scope.
An order is concluded when payment is confirmed by Mollie. Until that point, pending reservations and signups expire automatically and grant no entitlement.
6. Subscription terms
The monthly box is offered with three commitment options: monthly, quarterly, and yearly. Quarterly and yearly options are priced at a discount in exchange for a fixed commitment period.
Commitment. The commitment period begins on your signup date and ends a number of months later equal to the option chosen. By selecting a discounted option you accept that the full commitment is binding and that cancellation does not shorten it.
Billing cycle. The first charge is taken at signup. Subsequent charges are taken monthly on the same calendar day, anchored to your signup date, via SEPA Direct Debit under your mandate.
Cancellation. You may cancel at any time from your subscription management page. Cancellation takes effect at the end of your current commitment period; no refund is issued for cycles already billed within the commitment. After the commitment period ends, you will not be billed again.
Reactivation. If you cancel and change your mind before the commitment period ends, you may reactivate from the same management page; billing resumes on the original schedule.
Failed payment. If a SEPA debit fails, Mollie will retry per its standard schedule. After Mollie's retries are exhausted the subscription is paused; we will contact you by email. A paused subscription does not deliver and is not billed until reinstated.
Address changes. Address updates are validated against our delivery zone (see §8). An address outside the zone blocks self-serve change; reach us by email to discuss alternatives.
7. Tasting events
Event reservations confirm a specific seat at a specific event on a specific date. Capacity is finite and stated on the event page. Confirmation is by email after payment; please bring it (printed or on a phone) to check in at the venue.
Non-refundable. Event reservations are not refundable and not transferable to another date. This reflects the legal exception for events tied to a specific date under Article 6:230p, sub e of the Dutch Civil Code (the right of withdrawal does not apply to leisure services tied to a specific performance date). If you cannot attend, you are welcome to send another guest in your place at no charge — please email us the name change at least 24 hours before the event.
If we cancel an event ourselves, you receive a full refund within fourteen days.
8. Delivery
We deliver to a fixed list of postal-code prefixes in the Randstad area, served by our own van. The delivery zone is enforced at signup and on every address change; addresses outside the zone cannot subscribe through self-serve.
Subscription boxes ship once a month on a recurring weekday window communicated by email at the start of each month. We do not currently offer day-of-delivery time slots.
9. Right of withdrawal
Under the Dutch Civil Code (Burgerlijk Wetboek, Boek 6, Titel 5, Afdeling 2B), consumers normally have a fourteen-day right of withdrawal for distance contracts. The following statutory exceptions apply to our offer:
- Foodstuffs that perish quickly (Art. 6:230p, sub d): the subscription box and individual catalog items consisting of perishable food are exempt once dispatched.
- Sealed goods unsuitable for return for hygiene reasons (Art. 6:230p, sub f): once a sealed jar, bottle, package, or wedge has been unsealed, it cannot be returned.
- Leisure services tied to a specific date (Art. 6:230p, sub e): tasting events fall under this exception. See §7.
For non-perishable, unopened catalog items you withdraw from within fourteen days of receipt, return shipping is at your cost; refund is issued within fourteen days of our receipt of the returned goods in saleable condition.
10. Conformity, complaints, and warranty
Goods are delivered in conformity with the contract under Article 7:17 of the Dutch Civil Code. If a delivery is damaged, spoiled, or otherwise non-conforming, please email us within 48 hours of delivery with a photograph and a description; we will replace the affected item or refund it at our choice.
Complaints not resolved by direct contact may be referred to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11. Liability
Our liability is limited to the value of the order or subscription cycle to which the complaint relates, except where Dutch law forbids such limitation (death, personal injury, or intentional or grossly negligent conduct). Allergens are stated where known; customers with food allergies are responsible for reading product pages and labels and for not consuming items that conflict with their condition.
12. Data protection
Personal data we collect to fulfil orders, manage subscriptions, and operate the site is processed in line with our privacy policy.
13. Governing law and jurisdiction
These terms and any agreement formed under them are governed by Dutch law. The competent court is the Rechtbank Amsterdam, without prejudice to any mandatory consumer right to bring proceedings in the consumer's country of residence.
